For example, in December, 2013, a Metro North Railroad train derailment took place at or about the Spuyten Duyvil station in the Bronx. By all accounts, train operator, William Rockefeller had dozed off behind the wheel and was proceeding around a sharp turn in the tracks at a speed of 82 MPH, nearly three times the posted speed limit. The train violently careened off the tracks, as passengers were thrown around inside the respective train cars. Four passengers of the train were tragically killed in the derailment and another 61 were injured. Mr. Albert is currently representing a woman who suffered a life changing brain injury in the derailment, which has been referred to as the deadliest train accident within New York City since a 1991 subway derailment in lower Manhattan, and the first accident in Metro-North’s history to result in passenger fatalities.
About a year and a half later, on May 12, 2015, an Amtrak Northeast Regional train from Washington, D.C. bound for New York City derailed and crashed on the Northeast Corridor in the Port Richmond neighborhood of Philadelphia. Of 238 passengers and 5 crew on board, 8 were killed and over 200 were injured, 11 critically. The train was traveling at 102 mph in a 50 mph zone of curved tracks when it derailed. Mr. Albert is representing a passenger who was critically injured as a result of this train derailment in his claims against Amtrak, its agents and employees.
